Can you obtain a power of attorney refund?

It is possible you could get part of your power of attorney or application fee refunded, whether you applied for an enduring power of attorney, or EPA, or lasting power of attorney, or LPA. This will depend on when you applied to register.

Who can claim?

The people who could apply for a refund are the donor, who is the individual who made the LPA or EPA application; the attorney appointed in an LPA or EPA; or the executor of the donor’s estate in the event of the donor’s death.

You must have applied to register the LPA or EPA between 1 April 2013 and 31 March 2017 in England and Wales.

An LPA allows you to state who should manage your financial and welfare affairs if you are unable to do so. If you do not already have a UK power of attorney, this can be arranged by a solicitor or through an online company such as //powerofattorneyonline.co.uk.

How much will be refunded?

How much you could claim will depend on when you paid your application fee and whether you paid the full or reduced fee. There will also be 0.5% interest. To find out the possible amounts you could claim for each year, take a look at the government’s power of attorney refund site.

How to claim

To make a claim, you will need to contact the Office of the Public Guardian by email, phone, or in writing. They will check whether you are eligible for a refund and, if so, how to make the claim.
